These Terms of Service ("Terms") govern your use of Raincup, an AI-powered relationship management assistant operated by BeSingular ("we", "us", "our"). By using the Service, you agree to these Terms.

Development Phase — Data Access Disclosure

Raincup is currently in active development. During this phase, user messages, CRM data, and conversation history may be accessed by the development team for audit, debugging, and quality assurance purposes. This access is necessary to improve the service, identify issues, and ensure things work correctly.

If you are not comfortable with the development team having access to your data, you should not use the service at this time. We will update this policy as Raincup moves out of the development phase.

1. Acceptance of Terms

By creating an account or using Raincup through any channel (web or WhatsApp), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Raincup is a conversational CRM (Customer Relationship Management) tool that allows you to manage contacts, companies, deals, activities, notes, and relationships through natural language conversations. The Service is accessible via web browser and WhatsApp.

Raincup uses artificial intelligence (AI) to interpret your messages and perform actions. While we strive for accuracy, AI responses may occasionally be incorrect or incomplete. You are responsible for verifying important information and actions.

3. Account Responsibilities

You must provide accurate information when creating your account
You are responsible for maintaining the security of your account credentials
You must notify us immediately of any unauthorized use of your account
You must be at least 16 years old to use the Service
You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Attempt to manipulate, exploit, or bypass the AI system's safety measures
Store sensitive personal data (medical records, financial account numbers, government IDs) in Raincup — it is not designed for regulated data
Use the Service to send spam or unsolicited messages
Attempt to access other users' data or accounts
Use automated tools to scrape or bulk-access the Service
Exceed the rate limits or usage quotas of your plan

5. Your Data

You retain ownership of all data you create in Raincup (contacts, deals, notes, etc.). We do not claim ownership of your content. We use your data only as described in our Privacy Policy.

You grant us a limited license to process, store, and transmit your data as necessary to provide the Service, including sending it to AI providers (Anthropic/OpenAI) for natural language processing.

6. AI Processing Disclaimer

Raincup uses third-party AI services to process your messages. By using the Service, you acknowledge that:

Your messages and CRM context are sent to AI providers for processing
AI responses are generated probabilistically and may contain errors
You should verify critical business actions before relying on them
We are not responsible for actions taken based on AI-generated advice

7. Service Availability

We strive to keep Raincup available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.

8. WhatsApp Messaging Policy

If you use Raincup via WhatsApp, the following messaging limitations apply due to WhatsApp's platform policies:

Raincup can only send you messages within a 24-hour window after your last interaction. If more than 24 hours have passed since your last message to Raincup, we cannot proactively reach you on WhatsApp until you message us again.
This means that features like daily rundowns, reminders, and onboarding tips may not be delivered via WhatsApp if you have not interacted with Raincup in the past 24 hours.
To keep receiving proactive messages on WhatsApp, simply send any message to Raincup at least once a day.
This limitation does not apply to the web interface — you can always access your data and receive notifications on the web regardless of your last interaction time.

9. Pricing & Payment

Raincup is currently free during early access. All features are available at no cost and no credit card is required. We plan to introduce paid plans in the future — pricing details will be published on our website with at least 30 days' notice before any charges apply. Early adopters will receive preferential terms. If you are on a paid plan and cancel, you will retain access until the end of your billing period.

10. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as is" without warranties of any kind
We are not liable for any indirect, incidental, special, or consequential damages
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
We are not responsible for data loss — you should maintain your own backups of critical business data

11. Termination

You may delete your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, we will delete your data within 30 days unless required by law to retain it.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Georgia, United States. Any disputes shall be resolved in the courts of Fulton County, Georgia.
